What if I bought my car “as is”?

Published by Lemon Law under FAQ

If you bought a car as is, it means that you accepted it with all its faults. Any post-sale defects are your problem. A car may be sold as is through a dealer or a private person. The implied warranty of merchantability does not automatically arise in as-is purchases.
Some states do not permit as-is sales for used cars.

The difference between a limited warranty and a full warranty

Published by Lemon Law under FAQ

If the dealer cannot fix a car or a part after a reasonable number of attempts, a full warranty provides for a car refund or replacement part, including installation. A dealer must replace the car or the part within a reasonable time. A full warranty applies to anyone who owns the car during the warranty period.

A limited warranty is any kind of warranty that is not a full warranty. Most car dealers do not give full warranties on the entire car, but may do so on a specific part, such as the battery. Most used car warranties are limited.

Implied warranty of fitness for a particular purpose

Published by Lemon Law under General Articles

Lets imagine that you tell the seller that you need the vehicle for a special purpose, f e.g towing a trailer, and the seller recommends a specific vehicle. You buy it, relying on the seller’s skill or judgment. It becomes an implied warranty of fitness for a particular purpose that the vehicle can do what you told the dealer you needed it to do.

Implied warranty of merchantability

Published by Lemon Law under General Articles

An implied warranty of merchantability applies in case the seller is a merchant, such as a car dealer. The implied warranty of merchantability is a statement that the car will do what it is supposed to. The quality guaranty means that the car should possess that level of quality needed to pass without objection in the trade; and the fitness guaranty means that the car should serve the buyer’s ordinary purposes.

Most people know that the implied warranty of merchantability is part of a new car purchase. All states impose implied warranties for used cars bought from dealers, unless the warranty is disclaimed specifically, in writing, by words like “as is” or “with all faults.” Implied warranties may have only limited duration.
