How do I know if my situation generally qualifies under the “lemon laws?”

Duing the time when vehicle has a manufacturing defect affecting value, safety or use, and it cannot be repaired after a reasonable number of attempts by the manufacturer’s or dealer’s service personnel, and the original repair occurred within the warranty period, then the vehicle is likely entitled to these legal protections.

Summary:
Certain vehicles fail to comply with the requirements of federal motor vehicle safety standard no. 118, ‘power operated window, partition, and roof panel systems.’ under the standard, the sunroof may only be closed when the ignition is on, or after the ignition is turned off, but before either of the front doors are opened. The affected vehicles may exhibit a condition where the sunroof can be closed after the ignition is turned off and the doors are opened.
 
Consequence:
This standard specifies requirements for power operated window, partition, and roof panel systems to minimize the likelihood of death or injury from their accidental operation.
 
Remedy:
Dealers will install a wire harness. The recall began on may 29, 2008.

Summary:
On certain vehicles equipped with a V8 engine,the power steering hose connectors may have been inadequately crimped which could result in a fluid leak.

Consequence:
If this were to occur, power steering assist may be lost and increased steering effort would be required at low speeds. Also, if the power steering fluid were to contact hot engine parts, an engine compartment fire could occur.

Remedy:
Dealers will replace the power steering gear inlet hose. The recall began on march 29, 2006.

If a vehicle is purchased “as-is” or “with all faults” does the Lemon Law apply?

As-is” or “with all faults” vehicle is being sold in the condition it is in. It is devoid of any warranties. The vehicle is accepted ”as it is” regardless of condition.

Do I have to keep my car in order to pursue restitution under the Lemon Law?

It is not necessary to keep the car. When selling it or trading it in to preserve your rights, certain procedures you should follow. When selling then car, the buyer should sign a written disclosure that states that he knows about the problems you have had with the vehicle. It is also advisable to get an expert inspection done to verify the existence of the problem in order to “preserve your evidence”, before you sell the vehicle.  You should notify the manufacturer that you believe the vehicle is a lemon and that you are selling it (or trading it in), before you sell the vehicle.

Summary:
On certain vehicles, the fuel tank is missing the adhesive layer that bonds the barrier layer to the outer shell of the fuel tank

Consequence: 
With this condition, fuel and/or fuel vapors could seep out between the layers, increasing the risk of a fire. 

Remedy:
Dealers will inspect the serial number on the fuel tank and replace the fuel tank if necessary. The recall began on november 13, 2006.

Summary:
Certain vehicles originally built with cloth seats that were equipped with an automatic air bag passenger sensing system and later reupholstered with aftermarket leather seat cover kits are involved. Testing has indicated that the aftermarket leather seat covers can cause the passenger sensing system to malfunction.

Consequence:
If the passenger sensing system malfunctions, the front air bag on the passenger side may be disabled when it should be enabled, or enabled when it should be disabled. In either case, in the event of a crash that requires air bag deployment, a front passenger’s level of injury may be increased.

Remedy:
Because a replacement leather seat cover that is compatible with the passenger sensing system is not availble, General Motors (GM) will repurchase these vehicles in accordance with the terms stated in letter to owners. The recall began on November 6, 2006.

Can an independent repair shop perform warranty repairs on my car?

NO. You must take it back to an authorized dealer for warranty repair work. The law states that the manufacturer must have a reasonable opportunity to repair the vehicle. An independent repair shop is not an agent of the manufacturer, so any repairs done at such a shop do not qualify as attempts by the manufacturer to repair the vehicle. A repair by an independent shop may void that portion of the warranty on the vehicle.

Do I have to take the vehicle back to the dealer I bought it from?

NO. All authorized dealers operate as the manufacturer’s agents for the purpose of warranty repairs. Any authorized dealer can do warranty work on your vehicle.
