Lemon Law: Mercedes Benz to Pay a Customer

For four years Marco Marquez has been trying to obtain his rights under the Wisconsin Lemon law and prove Mercedes-Benz USA LLC that his E 320 stopped working soon after the purchase.

According to the Lemon law of Wisconsin, the producer has to pay a refund or do a replacement within 30 days if the car won’t run or be repaired.

Marquez demanded a refund from Mercedes in October 2005 but was offered a replacement instead. Later on, the company agreed to provide a refund but didn’t do it within 30 days. The lawyer of Marquez filed a lawsuit, to which Mercedes answered by accusing the customer to have a bad faith and not giving specific information for refund on purpose.

The case had several turning points with both Marquez and Mercedes winning.

But the latest verdict of the Waukesha County Circuit Judge stated that Mercedes-Benz has to pay a refund for the car consisting of the doubled price of the vehicle plus interest, as well as the costs and legal fees for the lawsuit. The overall sum was $482,000.

This can be a very good lemon law case illustrating that a customer can achieve results by being consistent.

Summary:

General Motors is recalling certain model 2005-2010 Chevrolet Cobalt and model year 2007-2010 Pontiac G5 vehicles equipped with electric power steering. The driver may experience a sudden loss of power steering assist that could occur at any time while driving.

Consequence:

If power steering assist is lost, it would require greater driver effort at low vehicle speeds, increasing the risk of a crash.

Remedy:

Dealers will replace the electric power steering motor free of charge. The manufacturer has not yet provided ab owner notification schedule.
